Terms of Service
The agreement between you and CrawlNode: what you are buying, how it is billed, what each of us is responsible for, and how either of us can end it.
1. The agreement
These terms apply when you create an account on crawlnode.com or use the CrawlNode API. By doing either, you agree to them, and to the Acceptable Use Policy, the Privacy Policy and the Refund Policy, which are part of this agreement. "We" means CrawlNode. "You" means the person using the service and, if you use it for a company or other organisation, that organisation, which you confirm you are allowed to commit to these terms.
You must be at least 18 to use the service.
2. What you are buying
A physical node is the right to have one real Chrome browser running at a time, on Windows machines we own and run, for a month. You buy as many as you want to run at once, and you drive them through the API with a key we issue to you.
A node is a reservation, not a named machine. Each session is placed on a machine that is free when you start it. Browser time is not metered, but a session with no API calls for 30 minutes is reclaimed, and when a session ends, what was in the browser ends with it. Each node carries the limits and allowances shown on the pricing page, and the API enforces them.
3. Your account and keys
- Give us accurate information and keep your email address current, since that is how we reach you.
- Keep your password and API keys secret. A key is the whole of the access to your nodes: whoever holds it can use them.
- You are responsible for everything done with your account and your keys, including by people and software you give them to.
- If a key has been exposed, replace it from your account at once and tell us if you think it was misused.
4. Price and payment
- Nodes are billed monthly, at the price shown on the pricing page when you order, or at the price we have agreed with you in writing.
- Usage beyond an allowance is billed at the rates published on the pricing page. We email you before anything over an allowance is invoiced.
- You can add or remove nodes at any time. The limits on your key move with the count.
- Prices do not include taxes that apply where you are; where we are required to collect them, they are added to your invoice.
- If a payment fails and is not put right, we may suspend your keys until it is.
- We may change prices. A change does not apply to a period you have already paid for, and we will tell you by email before it applies to you.
Your first payment is refundable in full if you ask within 7 days, as the Refund Policy sets out.
5. Using the service
You may use the service only as the Acceptable Use Policy allows. You are responsible for what your browsers do, for complying with the law and with the terms of the sites you visit, and for having the right to collect and use whatever you collect.
If you bring your own proxies, you are responsible for having the right to use them.
6. Your data and ours
What your browsers load and what you take from it is yours. We process it only to provide the service, as the Privacy Policy describes, and we claim no rights in it.
The service itself, including the API, this website and its documentation, is ours. These terms let you use it; they do not transfer any of it to you.
7. Availability and changes
We work to keep the service running and your reserved browsers available, but we do not promise that it will be uninterrupted or free of errors. Machines fail, sites change, and a session can end without warning; build your work so that it can start a new one. We may carry out maintenance, and we may change or withdraw features, giving reasonable notice where a change takes away something you are paying for.
A site may still refuse or challenge a CrawlNode browser. We do not promise that any particular site can be loaded.
8. Suspension and ending the agreement
- You can cancel at any time from your billing page or by writing to us. Your nodes stay yours until the end of the period you have paid for.
- We may suspend or close an account that breaks these terms or the Acceptable Use Policy, that is not paid for, or whose use puts the service or other people at risk.
- We may stop providing the service altogether. If we do, we will give you notice and refund any period you have paid for and not received.
- When the agreement ends, your keys stop working. The Privacy Policy says what we keep afterwards.
9. Warranties
The service is provided as it is. To the extent the law allows, we make no warranties beyond those in these terms, including any implied warranty that the service is fit for a particular purpose.
10. Liability
To the extent the law allows, neither of us is liable to the other for lost profits, lost data or indirect losses arising from the service, and our total liability to you for any claim is limited to what you paid us in the twelve months before the claim arose. Nothing in these terms limits liability that cannot be limited by law.
If someone brings a claim against us because of how you used the service in breach of these terms, you agree to cover the reasonable cost to us of that claim.
11. Changes to these terms
We may update these terms. When we do, we change this page and the date at the top, and for a change that materially affects you we will tell you by email before it applies. If you keep using the service after a change applies, you accept it; if you do not accept it, you can cancel.
12. General
- If part of these terms cannot be enforced, the rest still applies.
- If we do not enforce a term at once, we have not given it up.
- You may not transfer this agreement to someone else without our agreement. We may transfer it as part of a sale or reorganisation of the business.
- These terms, with the policies they refer to and anything we have agreed with you in writing, are the whole agreement between us.
